1. Who controls your information
Lexometry USA Inc., a Wyoming company (“we,” “us,” or “our”), is responsible for the personal information described in this Privacy Policy. EIN-USA is a separate administrative service operated by Lexometry USA Inc.
This Policy applies to ein-usa.com, order communications, support requests, IRS EIN fax assistance, EIN document preparation, digital guides, and annual filing assistance.
2. Information we collect
Depending on the service, we may collect:
- Contact information: name, email address, telephone number, country, and mailing address.
- Business information: company name, entity type, formation jurisdiction, business address, responsible-party details, filing type, and related corporate information.
- Tax and identification information: SSN, ITIN, or other taxpayer information only when supplied and reasonably required for the requested service.
- Order information: selected service, amount, payment status, Stripe session reference, download activity, upgrade status, and order timestamps.
- Fax information: destination number supplied by the customer, intended recipient, page count, instructions, transmission status, document filename, file hash, and the uploaded PDF.
- Communications: messages, support correspondence, consent records, and documents you send to us.
- Technical information: IP address, browser and device information, request logs, security events, and acceptance timestamps.
We do not record telephone calls unless we provide notice before recording. We may retain emails and written support communications as part of the order and compliance record.
3. How we collect information
We collect information directly from you when you place an order, complete a form, upload a PDF, accept our terms, request support, or communicate by email or telephone.
We also receive limited transaction information from Stripe and technical or security information from our hosting, email, and network systems. If another authorized person submits an order for you, we may receive information from that person.
4. How we use information
We use personal information to:
- create, verify, and administer orders;
- provide purchased guides, document preparation, fax transmission, and forwarding of related IRS responses received through the return fax number authorized by the customer;
- communicate about missing information, processing status, delivery, and customer support;
- send transactional emails, secure links, and optional assistance included in the order flow;
- confirm authorization and record acceptance of our legal terms;
- protect customers, prevent fraud, and secure our systems;
- maintain accounting, transaction, transmission, and compliance records;
- respond to disputes, refunds, chargebacks, subpoenas, court orders, or other lawful requests;
- diagnose errors and improve the reliability and usability of the service.
We do not use uploaded tax or fax documents to create advertising profiles, and we do not sell or rent customer personal information.
5. Legal bases for processing
Where applicable law requires a legal basis, we rely on one or more of the following:
- Contract: processing necessary to provide the service you purchased or requested.
- Consent: authorization to transmit documents, receive a related IRS fax response through our designated number, forward that response to the order email, receive electronic communications, or process information where consent is required.
- Legitimate interests: security, fraud prevention, service administration, dispute resolution, and improvement of our operations, balanced against your rights.
- Legal obligation: accounting, tax, sanctions, law-enforcement, court, and regulatory requirements.
- Legal claims: establishing, exercising, or defending legal rights.
You may withdraw consent for future processing where consent is the applicable basis. Withdrawal does not affect earlier lawful processing and may prevent us from completing a requested service.
7. Fax files and sensitive documents
Fax PDFs are stored outside the public website directory. The database may contain a private file reference and operational metadata rather than the PDF content itself.
To reduce the risk of losing an active request, a fax request and its PDF attachment may also be delivered to controlled EIN-USA operational email accounts. Email delivery and fax transmission are not risk-free, and no internet transmission can be guaranteed completely secure.
Authorized personnel may access documents only as needed to prepare, transmit, review, support, or document the requested service. Customers are responsible for ensuring they have authority to disclose every document and data element submitted.
8. How long we retain information
We retain information only for as long as reasonably necessary for the purpose collected, including completing the service, forwarding expected responses, maintaining accounting and transmission records, preventing fraud, resolving disputes, and meeting legal obligations.
Retention periods differ by record type:
- order, payment, consent, accounting, and legal records may be retained for the period required by tax, contract, fraud-prevention, and limitation laws;
- fax and customer documents are retained only while operationally or legally necessary and may also remain temporarily in restricted email systems or backups;
- server and security logs are retained for a limited operational and security period;
- information subject to an active dispute, chargeback, investigation, or legal hold may be retained until the matter is resolved.
When information is no longer required, we delete, anonymize, or securely dispose of it where reasonably practicable. Backup copies may remain until overwritten through the ordinary backup cycle.
9. Security measures
We use reasonable administrative and technical safeguards appropriate to the nature of the information, including encrypted HTTPS connections, restricted administrative access, authenticated payment processing, non-public document storage, access logging, and system updates.
No security system is perfect. We cannot guarantee absolute confidentiality or that unauthorized access, hardware failure, malicious activity, or transmission errors will never occur.
If we determine that a security incident requires notification, we will provide notice as required by applicable law.
10. International customers and data transfers
EIN-USA is operated from the United States. If you access the service from Canada, the United Kingdom, the European Economic Area, China, India, Pakistan, or another jurisdiction, your information may be transferred to and processed in the United States and other locations used by our service providers.
Privacy laws in those locations may differ from the laws in your country. Where applicable law requires additional safeguards for an international transfer, we will use an appropriate lawful mechanism or another legally permitted basis.
11. Your privacy rights
Depending on your location and applicable law, you may have the right to:
- request access to personal information we hold about you;
- request correction of inaccurate or incomplete information;
- request deletion, subject to legal and operational exceptions;
- object to or restrict certain processing;
- request that we limit the use or disclosure of sensitive personal information where applicable law provides that right;
- receive eligible information in a portable format;
- withdraw consent where processing is based on consent;
- appeal our refusal of a privacy request where applicable law provides an appeal right;
- appeal or complain to an applicable privacy authority.
To make a request, email support@ein-usa.com with the subject “Privacy Request.” We may request reasonable information to verify your identity and authority. We will not discriminate against you for exercising an applicable privacy right.
You may use an authorized agent to submit a request where permitted by law. We may require written authorization, verification of your identity, and reasonable evidence of the agent’s authority before acting on the request.
If we deny a request, you may ask us to review the decision by replying with the subject “Privacy Appeal.” We will explain the result and, where required, provide information about contacting the appropriate regulatory authority.
We do not sell personal information, share it for cross-context behavioral advertising, or use it for automated decisions producing legal or similarly significant effects.
13. Children
Our services are intended for adults and business representatives. They are not directed to children under 18, and we do not knowingly collect personal information directly from children. Contact us if you believe a child has submitted information without proper authorization.
14. Changes to this Policy
We may update this Policy to reflect changes in our services, providers, security practices, or legal obligations. The updated effective date will appear at the top of this page.
If a change materially affects how previously collected sensitive information is used, we will provide additional notice or obtain consent where required by law.
